Terms of Service

1. Agreement to Terms

By accessing or using MailGenius AI (the “Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Eligibility and Accounts

You must be at least 18 years old and capable of entering into a binding contract. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

3. Subscriptions and Billing

MailGenius AI offers Free, Starter, and Pro subscription plans. Paid plans are billed in advance on a recurring monthly basis through our payment processor. You authorize us to charge the payment method on file. Prices are in Euros and may be subject to applicable VAT or local taxes for EU users.

You may upgrade, downgrade, or cancel your subscription at any time from your account settings. Downgrades or cancellations take effect at the end of the current billing period.

4. Refund Policy

Refund requests for paid subscriptions must be submitted within 7 days of the initial charge. Refund requests received more than 7 days after the charge will not be processed. Refunds are issued at our sole discretion and may be prorated based on usage.

5. Acceptable Use

You may use the Service only for lawful purposes. You may not use the Service to generate spam, deceptive content, harassing messages, or content that violates any applicable law or third-party rights. We reserve the right to suspend or terminate accounts that violate these rules.

6. User Content and Data

You retain ownership of any prospect data and generated emails you input or create. You grant us a limited license to process that data solely to provide the Service to you. We do not sell your data.

7. Intellectual Property

MailGenius AI and its underlying software, designs, and branding are owned by MailGenius AI. Subject to these Terms, you are granted a limited, non-exclusive, non-transferable license to use the Service during your subscription period.

8. Limitation of Liability

To the maximum extent permitted by law, MailGenius AI is not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, or data arising from your use of the Service. Our aggregate liability is limited to the amount you paid for the Service in the 12 months preceding the claim.

9. GDPR and EU Users

For users in the European Economic Area, we process personal data in accordance with the General Data Protection Regulation (GDPR). Our role and responsibilities are described in the Privacy Policy. We act as a data controller for account and billing data, and as a data processor for generated content on your instructions.

10. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated by email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the jurisdiction in which MailGenius AI operates, without regard to conflict of laws principles. Disputes will be resolved in the competent courts of that jurisdiction.
